In the Bible

The Bible lists several types of relationship which it regards as incestuous unions; one list appears in Deuteronomy, and two lists occur in the Book of Leviticus. These lists only mention relationships with female relatives; excluding lesbianism, this implies that the list is addressed to men. Since the lists would then describe women with whom it is forbidden for a man to have a relationship, they also indirectly imply a list of men with whom it is forbidden for a woman to have a relationship. These lists then compare as follows (blue = forbidden for men only, pink = forbidden for women only, purple = forbidden for both men and women)

One of the most notable features of all the lists is that sexual activity between a man and his own daughter is not explicitly forbidden, although the first relation mentioned after the Levitical prohibition of sex with “near kin” is that of “thy father.” The Talmud argues that this absence is because the prohibition was obvious, especially given the proscription against a relationship with a granddaughter. As with the case of a man’s own daughter, the shortness of the list in Leviticus 20, and especially of that in Deuteronomy, are explained by classical Jewish scholarship as being due to the obviousness of the missing prohibitions.

Apart from the case of a man marrying his daughter, the list in Leviticus 18 roughly produces the same rules as were followed in early (pre-Islamic) Arabic culture. However, most tribal nations also disliked exogamous marriage – marriage to completely unrelated people.

Judaism’s view is that prior to the giving of the Torah at Mount Sinai, some of the prohibitions only applied voluntarily. Thus in several prominent cases in the Torah, the incest rules are ignored in favour of marriage to a close relative; Jacob is described as having married his first wife’s sister.

Secular views

Some secular Biblical scholars have instead proposed that forbidding incest with a daughter was originally in the list, but was then accidentally left out from the copy on which modern versions of the text ultimately depend, due to a mistake by the scribe.

Hugh Gilbert, the Catholic Bishop of Aberdeen who said he ‘loved’ gay people told the Scottish Catholic Observer: “Why is it alright for a man to marry another man, but not alright for him to marry two women? If we really want equality, why does that equality not extend to nieces who genuinely, truly love their uncles?”

Surprisingly he went on to suggest that he has some experience of incest within Aberdeen: “And, if you say that such things don’t happen, that they are mere freaks of nature, extreme examples dreamed up for the sake of argument, I say you need to spend more time in the parish.”

The bishop did say that he will continue to work for gay people, just not marry them: “As Bishop of Aberdeen, I know there are gay people amongst the community of the Church. I promise I will always respect and love them and uphold them in their relationship with the God who loves them. But I won’t marry them. It just can’t be done.”

He added: “The truth is that a government can pass any legislation it likes, it can legislate to say that everything with four legs is a table, even when it’s a dog and not a horse, but that won’t make it so.”

Tim Hopkins, director of Equality Network, said: “We are very disappointed the Bishop of Aberdeen should choose to com­­pare same-sex marriage to polygamy and incest. That is offensive and uncalled for.”

Earlier this year, the head of the Catholic Church in Scotland, Cardinal Keith Michael Patrick O’Brien, said that gay marriage is a “grotesque subversion of a universally accepted human right”. He suggested that same sex marriage will lead to three way marriages and compared the government’s support for equality to legalising slavery.

Maharashtra and Rajasthan have the dubious distinction of highest number of incest-rape cases registered in 2011, as per National Crime Record Bureau figures for 2011.

In 2011, 267 incest-rape cases were registered in the country of which 43 were in Maharashtra and Rajasthan each, which accounts for more than 15.3%. Of the 43 cases in Maharashtra, four were from in Mumbai.

“One of the reasons why Maharashtra topped the list could be because there is more awareness here, resulting in more cases registrations. The only way to curb incest-rape is to ensure that child is comfortable discussing the issue with at least one member in the family,” said Dr Harish Shetty, a psychiatrist from Mumbai.

“In many cases, the child does not even understand how to explain what he/she had gone through. Also, schools should discuss such issues with children and teach them to inform either their parents or teachers in case they become victims to such offences,” he added.

The maximum number of incest-rape victims in Maharashtra are in the age group of 14-18 years (14 cases), followed by 18-30 years (10 cases) and 10-14 years (nine cases). The remaining six victims are 10 years and below.

In 2011, 15,728 rape cases were registered in Maharashtra, of which in 1,699 cases the offenders were known to the victims. In 43 cases the victim were raped by the parent or a close family member. While in 97 cases a relative was the offender, in 566 cases it was the neighbour.

It has often been observed that in incest-rape cases, the victims do not discuss their ordeal with another family member fearing that no one might believe them. Hence, they continue to be victimised for several years.

Many cases also go unreported as even after the problem has been addressed, the family does not approach the police fearing social stigma.

Usha Kiran Makasare, senior council for CBI and former public prosecutor who fought against women atrocities, said: “The conviction rate in incest-rape cases in high unless the victim turns hostile after being pressured by the family. The victims face severe mental torture as they are raped by the person they trust and then they have to narrate their ordeal again and again — first to the family then to the police and court.”
